1. Acceptance of Terms

By accessing or using the services provided by Gym Holistic ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, members, and others who access our facilities, programs, or services.

2. Use of Services

Gym Holistic provides fitness training, health optimization services, nutritional guidance, and related wellness programs. By using our services, you agree to:

• Provide accurate and complete information during registration
• Maintain the confidentiality of your account credentials
• Use our facilities and services in accordance with posted rules and guidelines
• Conduct yourself in a respectful and professional manner at all times
• Not engage in any activity that could harm other members or damage our property

3. Membership and Payments

All membership fees and service charges are non-refundable unless otherwise stated in writing. Payment terms include:

• Monthly membership fees are due on the first day of each billing cycle
• Personal training sessions and specialized programs require advance payment
• Failure to pay fees may result in suspension or termination of membership
• We reserve the right to modify pricing with 30 days' advance notice to members
• All fees are subject to applicable taxes

4. Cancellation Policy

Members may cancel their membership subject to the following conditions:

• Written notice must be provided at least 30 days before the desired cancellation date
• Cancellation requests must be submitted via email to info@gymholistic.com or in person at our facility
• Members remain responsible for all fees through the end of the notice period
• Personal training packages and specialized programs may have separate cancellation terms
• No refunds will be issued for partial months or unused services

5. Health and Fitness Disclaimer

IMPORTANT: Exercise and physical activity involve inherent risks. By participating in our programs, you acknowledge and accept these risks. You agree that:

• You should consult with a physician before beginning any exercise program
• You are physically capable of participating in the activities you choose
• You will immediately discontinue exercise and inform staff if you experience pain, discomfort, or distress
• Gym Holistic and its staff are not liable for any injuries, health conditions, or complications arising from your participation
• Our services are not a substitute for professional medical advice, diagnosis, or treatment
• Nutritional guidance provided is for educational purposes and is not medical nutrition therapy

6. Assumption of Risk and Waiver

You understand that physical exercise and training can be strenuous and subject to risk of serious injury. You voluntarily assume full responsibility for any risks of loss, property damage, or personal injury that may be sustained by you as a result of participating in our programs. You agree to release, waive, discharge, and covenant not to sue Gym Holistic, its owners, employees, trainers, and agents from any and all liability for injury or damage.

7. Privacy and Data Protection

Your privacy is important to us. We collect and use your personal information in accordance with our Privacy Policy. By using our services, you consent to the collection and use of your information as described in our Privacy Policy. We implement appropriate security measures to protect your data, but cannot guarantee absolute security.

8. Intellectual Property

All content, materials, programs, and training methodologies provided by Gym Holistic are our proprietary intellectual property. You may not reproduce, distribute, modify, or create derivative works without our express written consent. Our name, logo, and branding are protected trademarks.

9. Limitation of Liability

To the fullest extent permitted by law, Gym Holistic shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services. Our total liability shall not exceed the amount of fees paid by you in the three months preceding the event giving rise to the claim.

10. Modification of Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on our website and will become effective immediately upon posting. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of Oakland County, Michigan.
